Terms of sale

These terms cover every order placed through this site. Placing an order means you accept them, so they are written to be read rather than skimmed past.
Who you are buying from
GTM Cakes is [your registered company name and number, or your own name if you are a sole trader], of [registered address]. Email contact@gtmcakes.com, phone +44 7721 441643.
We bake through partner bakeries across London rather than one central kitchen, which is how a cake gets baked the morning it is delivered instead of driven across the city. You are contracting with us, not with the bakery. If something goes wrong, you come to us.
Allergens: read this before you order
Everything we bake is made in kitchens that handle wheat (gluten), eggs, milk, soya and nuts, including peanuts. We cannot guarantee that any cake is free from any allergen, however carefully a bakery works, because the same rooms and equipment handle all of them.
The 14 regulated allergens are: celery, cereals containing gluten, crustaceans, eggs, fish, lupin, milk, molluscs, mustard, tree nuts, peanuts, sesame, soya, and sulphur dioxide/sulphites.
- Standard sponges contain wheat (gluten), eggs, milk and soya. Buttercream and edible print contain milk and soya. [Confirm against each bakery's specification and correct this line.]
- May contain tree nuts and peanuts, through the shared kitchen.
- Ingredient and allergen details for a specific order are available before you pay. Call or email us and we will send the bakery's specification for the exact cake you are ordering. Ask; we would much rather you did.
- Every box is labelled with a full ingredient list and the allergens emphasised, and that label travels with the cake to the recipient's desk.
You are sending food to people who did not ask for it. The recipient has no idea what is in it and no chance to ask you. Tell whoever is receiving the delivery that the box carries an ingredient label, and do not order for someone you know has a serious allergy. A note in the bakery instructions box is a request, not a guarantee, and we will tell you plainly if a bakery cannot honour it.
Placing an order
- Prices on this site are in pounds sterling. We are not VAT registered, so no VAT is charged and none is shown. You get an invoice with every order.
- Your order is an offer to buy. A contract exists when we confirm payment on screen and by email, not when you click Pay, and not when the card is authorised.
- We may decline an order. The usual reasons are capacity on the day you have chosen, an address we cannot reach, or artwork we will not print (see below). If we decline, you are refunded in full within five working days and we will normally have called you first.
- If a price is obviously wrong (a £100 cake listed at £10) we are not obliged to honour it. We will tell you and let you choose whether to go ahead at the right price or take a refund.
Lead times and delivery
- Notice we need: next working day for pastry boxes, two working days for 6" and 8" cakes, three for a 10". The order form will not let you pick a date that does not clear the lead time for everything in your basket.
- We deliver anywhere inside the M25, Monday to Friday, in the slot you choose. We do not deliver on weekends or bank holidays.
- Delivery is to the building's reception, not to a named desk, unless the building lets us go further. We photograph the handover and send you the photo the same day.
- Delivery slots are our honest intention, not a guarantee. London traffic being what it is, we will tell you as soon as we know if a slot is going to slip.
When a delivery does not work
- Reception turns it away, or nobody is there. We rebook once at no charge, on the next available date that suits you. If the second attempt fails too, we have to charge for the cake, which will have been baked twice, but we will not charge for the delivery.
- The address was wrong. Same as above. We use what you give us, so please check it.
- We got it wrong. Wrong cake, wrong day, wrong artwork, damaged in transit, or it simply never arrived. Tell us within 48 hours of the delivery date and you choose: we rebake and redeliver free, or we refund in full. We will not argue you round the houses over a cake.
Changing or cancelling an order
Cakes are perishable and printed to order, so the usual 14-day right to change your mind under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 does not apply. Those Regulations specifically exclude goods that are personalised and goods liable to deteriorate quickly. That is the law, not a policy we invented, and it is why the windows below matter.
- More than 48 hours before your delivery date: cancel or change anything (date, artwork, addresses, sizes) and any reduction is refunded in full.
- Inside 48 hours: the bakery has bought ingredients and scheduled the bake. We can usually still change the delivery date or the wording. We cannot refund a cancellation.
- On the day: the cake exists and the driver has it. No refunds, but tell us anyway. We would rather redirect it somewhere useful than bin it.
None of this affects your statutory rights if the goods are faulty, not as described, or not of satisfactory quality.
What we will and will not print
You write the message; we print it. What we will not put on a cake, and will refund rather than bake:
- Anything defamatory, harassing, threatening, or targeting an individual rather than addressing them.
- Anyone else's trade marks or copyrighted artwork without permission. When you upload artwork you are telling us you have the right to use it, and you cover us if that turns out to be untrue.
- Anything unlawful, or anything we think would land the recipient in an awkward conversation with HR.
We are not the taste police and we will print a joke at your own expense happily. If we are not going to bake something, we will call you rather than quietly cancel.
The addresses you give us
You are responsible for having a lawful reason to send someone a cake at their place of work, and for the accuracy of the details you supply. We use them only to bake and deliver that order, and we delete them afterwards. The privacy policy sets out exactly when. If a recipient asks us to remove their details, we do it immediately and without asking you.
Sending a cake to a regulated business (financial services, legal, public sector) may trip their gift policy. That is between you and them, but keep the value low and expect it to be logged.
Payment
Card payments are handled by Stripe. We never see or store your card number. If a payment is reversed or charged back after we have baked and delivered, we will invoice you for the amount owed.
Where our responsibility ends
If we get an order wrong we will put it right, and our liability for any one order is capped at what you paid for it. We are not liable for indirect or consequential losses: the deal the cake did not win, the meeting it did not get you. Cake is a good channel; it is not a guarantee, and nothing on this site says otherwise.
Nothing here limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited. That expressly includes our responsibility for the safety of the food we sell you.
If something goes wrong
Email contact@gtmcakes.com or call +44 7721 441643. We answer within two working hours in office hours and we will tell you what we are going to do about it within one working day. If we cannot settle it between us, you can take it to [an ADR provider: name one, or delete this sentence].
Changes to these terms
The terms that apply to your order are the ones published when you placed it. If we change them we update the date at the top; we will not apply a change retrospectively to an order already placed.
Governing law
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.
